In short
Professional indemnity insurance covers professionals and firms against claims that negligent advice, an error or an omission in their work caused a client financial loss.
Also called: PI insurance, errors and omissions insurance, E&O insurance, professional liability insurance, medical indemnity insurance
What is professional indemnity insurance?
Professional indemnity (PI) insurance is a liability policy for people and firms who sell advice or expertise. It pays the compensation a professional is legally liable to pay a client, and the legal costs of defending the claim, when the client alleges a loss caused by negligence, an error, an omission or a breach of professional duty. In technology and financial services the same cover is often called errors and omissions (E&O) insurance.
PI differs from general liability insurance in what it responds to. General liability covers bodily injury and property damage. PI covers pure financial loss from bad advice or faulty service, such as a design flaw, a missed filing deadline or an incorrect valuation.
Who buys professional indemnity insurance in India
| Buyer | Typical claim |
|---|---|
| Doctors, hospitals, diagnostic centres | Alleged medical negligence, often filed before consumer commissions |
| Chartered accountants, company secretaries, auditors | Errors in audit, tax or compliance work |
| Architects, engineers, project consultants | Design defects causing cost overruns or structural damage |
| IT and software firms | Failure of a system or service to perform as contracted |
| Insurance brokers and corporate agents | Placing the wrong cover, missing a renewal, wrong advice to a client |
| Financial advisers and distributors | Unsuitable advice or execution errors |
Some professionals must hold PI cover. IRDAI requires insurance brokers to maintain professional indemnity insurance, with minimum limits linked to their annual remuneration, and expects corporate agents and other intermediaries to do the same. For many other professions, the requirement comes from contracts: clients, government tenders and lenders often ask consultants to show PI cover of a stated amount.
How professional indemnity insurance works
- Claims-made basis. PI policies respond to claims first made during the policy period, for work done after the retroactive date. A claim made after the policy lapses is not covered, even if the work was done while it was in force.
- Limit and deductible. The limit of indemnity is usually per claim and in the aggregate. A deductible or excess applies to each claim.
- Defence costs. Usually inside the limit. Large cases can use up much of the cover in legal fees alone.
- Exclusions. Fraud and dishonesty, contractual guarantees beyond normal professional duty, known prior claims, fines and penalties, and (in medical PI) acts outside the practitioner's qualification.
- Consumer law. Many PI claims against doctors and hospitals in India arise under consumer protection law, where the Supreme Court has long held that medical services for a fee are a "service". In 2024 the Supreme Court held that advocates' services are not covered by the Consumer Protection Act, 2019, which narrows that route for claims against lawyers.
What professional indemnity insurance means for distribution
- Associations are the best channel. Medical associations, CA and architect bodies, and IT industry groups run or endorse group PI schemes. A scheme tie-up gives access to thousands of members with a simple product, though pricing and claims experience must be monitored by specialty.
- Medical PI is a large retail opportunity. Individual doctors' PI is high-volume and low-ticket. Digital journeys, clinic-level packages and hospital tie-ups work well, but the adviser must explain claims-made rules and the need to keep cover running after retirement.
- Intermediaries need it themselves. Brokers, corporate agents and distribution platforms carry their own E&O exposure. Their compliance teams should review the limit annually against business growth and the regulatory minimum.
- Contract review creates demand. Consultants winning large contracts often discover a PI requirement at signing. Being ready with fast quotes for stated limits converts these urgent requests.
- Continuity matters most at renewal. Losing the retroactive date when switching insurers is the most damaging mistake. A good renewal process confirms it in writing and records any circumstances that could lead to a claim.
